Terms of Service

Your agreement to use WhoDid platform services

1. Agreement to Terms

Acceptance

By accessing and using WhoDid ("the Platform," "Service," or "we"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

WhoDid is a platform that connects freelancers and independent contractors with potential clients by showcasing completed projects, testimonials, and professional portfolios. Our services include:

Profile Management

Profile creation and portfolio management for freelancers

Project Showcase

Project showcase and client testimonial features

Discovery Tools

Search and discovery tools for clients

Communication

Communication tools between freelancers and clients

Rating System

Rating and review systems for quality assurance

3. User Accounts

Account Creation

To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Responsibility

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Conduct

You agree not to use the Platform to:

  • Violate any local, state, national, or international law or regulation
  • Transmit or procure the sending of any unsolicited advertising or promotional material
  • Impersonate or attempt to impersonate the Company, employees, another user, or any other person
  • Engage in any conduct that restricts or inhibits anyone's use of the Platform
  • Use any robot, spider, or other automatic device to access the Platform
  • Introduce any viruses, trojan horses, worms, or other material that is malicious

5. Content and Intellectual Property

Your Content

You retain ownership of any intellectual property rights that you hold in content you submit to the Platform. However, by posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on the Platform.

Platform Content

The Platform and its original content, features, and functionality are and will remain the exclusive property of WhoDid and its licensors. The Platform is protected by copyright, trademark, and other laws.

6. Privacy Policy

Privacy Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Platform, to understand our practices.

7. Payments and Fees

Platform Fees

WhoDid may charge fees for certain premium features or services. All fees are described in our current fee schedule and are subject to change with notice.

Third-Party Payments

Payment processing services are provided by third-party providers. By using these services, you agree to their terms and conditions.

8. Termination

Account Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

You may terminate your account at any time by contacting us or using the account deletion feature in your profile settings.

9. Disclaimers and Limitation of Liability

Disclaimers

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Platform or the information included on it.

Limitation of Liability

In no event shall WhoDid be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

10. Indemnification

Legal Protection

You agree to defend, indemnify, and hold harmless WhoDid and its licensee and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

11. Governing Law

These Terms shall be interpreted and governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

12. Changes to Terms

Updates to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
